This month barrister Tom Russell launched a new service, Truce Mediation.
With over 30 years working as a litigator (solicitor and barrister) and 17 years as a mediator, Tom uses his extensive experience to assist clients in a range of matters with a focus on property cases, including disputes arising from trusts of land and contested probate.
Those who have worked with Tom previously know that he brings his friendly, informal and personable style to mediations and works hard to help clients explore the emotional realities which lie beneath the surface of the disputes in which they find themselves.
Tom is joined in this venture by former Hannah Scothern, formerly Chief Operating Officer at KCH Garden Square. Hannah is the Business Manager and first point of contact for clients at Truce Mediation.
The benefits of mediation are now generally acknowledged in the profession.
Further, with the imminent changes to the CPR, it seems likely that the courts will be even more willing to impose sanctions in cases where a litigant has declined to mediate. This is consistent with the general trend which can be traced back to the Halsey case in 2004 and continued last year with the Churchill case.
